Notice of Complete Application for Plan of Subdivision - File #15T-25001

The County of Peterborough has received a complete application for a plan of subdivision, in accordance with Sections 51(17) and (19.1) of the Planning Act. The application has been assigned file number: 15T-25001 (Subdivision).

Location
key map indicates the location of the lands which are subject to the application.  The lands are located in Part Lot 12, Concession 11, Cavan Ward, Township of Cavan Monaghan, and are known municipally as 1910 County Road 10.

Purpose and Effect of the Application
The purpose of the subdivision application is to create five (5) new lots for permanent residential uses. The proposed new lots will maintain frontage solely along Sharpe Line and are anticipated to be serviced by private individual site services. While the entirety of the subject property is roughly 40.9 hectares (101.1 acres) in size, the subject application only applies to 1.43 hectares (3.53 acres) along Sharpe Line and indicated in the key map.

The subject lands are currently designated as Hamlet in the Township Official Plan. The balance of the property is within both the Agricultural and Natural Linkage designations.

The Right to Appeal
If a person or public body would otherwise have an ability to appeal the decision of the County of Peterborough to the Ontario Land Tribunal but does not make oral submissions at a public meeting, if one is held, or make written submissions to the County of Peterborough in respect of the proposed plan of subdivision before the approval authority gives or refuses to give approval to the plans, the person or public body is not entitled to appeal the decision of the County of Peterborough to the Ontario Land Tribunal.

If a person or public body does not make oral submissions at a public meeting or make written submissions to the County of Peterborough in respect of the proposed plan of subdivision before the approval authority gives or refuses to give approval to the draft plan of subdivision, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

Important Legislation Changes - Public Meeting and Appeal Rights
Please note that Bill 23, the More Homes Built Faster Act, made changes to Section 51(20) of the Planning Act which no longer requires Municipalities to hold public meetings for draft plans of subdivision/condominium.

Further, Bill 108, the More Homes, More Choices Act, made changes to Section 51(39) of the Planning Act which no longer permits third party appeals to decisions for draft plans of subdivision/condominium. Instead, appeals are restricted to "specified persons" which includes the province, the Municipality, the applicant, and utility companies.

This notice is circulated as a requirement of The Planning Act and is intended to provide the public and ministries / agencies with information related to the proposed application, in order to solicit public / agency input. This notice does not infer that the application is approved.
