Notice of Complete Application for an Official Plan Amendment and Zoning By-law Amendment

Take notice that the Corporation of the County of Peterborough has received a complete application for an Official Plan Amendment in accordance with Section 22(6.4) of the Planning Act.  The application has been assigned file number 15OP-25008. 

And take notice that the Corporation of the Township of Douro-Dummer has received a complete application for a Zoning By-Law Amendment (ZBA) in accordance with Section 34(10.4) of the Planning Act. The application has been assigned file number R-02-25. 

Location 

A key map is attached which indicates the location of the lands which are subject to the application.  The lands are located on Lot 20, Concession 06, Douro Ward, Township of Douro-Dummer, and are known municipally as 4488 County Road 29. 

Purpose and Effect of the Application 

The purpose of the Official Plan Amendment (OPA) and Zoning By-law Amendment (ZBA) applications is to allow for the establishment of an operations and maintenance centre on the subject property. 

The OPA proposes to redesignate the subject lands from ‘Rural’ to ‘Rural Industrial’ which will apply to much of the subject property, and ‘Environmental Constraint’ which will apply to a wetland area and associated buffer. The OPA will also delete Site Specific Policy 6.2.2.11(d)(i). 

The ZBA proposes to change the zoning from ‘Special District 101 Holding (S.D. 101-H)’ to ‘Restricted Industrial (M1)’ which will apply to much of the subject property, except for a wetland area and associated buffer which are to be placed in the ‘Environmental Constraint (EC)’ Zone. The ZBA also requests a site-specific provision to permit a greater maximum driveway width.

The Right to Appeal 

If a person or public body would otherwise have an ability to appeal the decision(s) of the Township of Douro-Dummer/County of Peterborough to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Douro-Dummer/County of Peterborough before the proposed official plan amendment is adopted, the person or public body is not entitled to appeal the decision. 

If a person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Douro-Dummer/County of Peterborough before the proposed by-law is passed/official plan is adopted, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so. 

A Public Meeting concerning these applications has not yet been scheduled. A notice will be provided in due course advising the date, time and location of the public meeting.
