Notice of Public Meeting for Official Plan Amendment and Zoning By-Law Amendment

The County of Peterborough has received a complete application for an Official Plan Amendment in accordance with Section 22(6.4) of the Planning Act.  The application has been assigned file number 15OP-22001.

The Township of Selwyn has received a complete application for a Zoning By-Law Amendment (ZBA) in accordance with Section 34(10.4) of the Planning Act. The application has been assigned file number C-01-22.

Location
A key map is attached which indicates the location of the lands which are subject to the application. The lands are located at Part Lot 3, Concession 9 (Ennismore Ward) in the Township of Selwyn having the municipal address of 187 Kildeer Lane.

Purpose and Effect of the Application
The Official Plan amendment application proposes to change the land use designation on the subject property from “Rural” to “Lakeshore Residential” which would facilitate the creation of a new lot by consent (severance). The proposed Zoning By-law Amendment will amend the existing zoning to permit a residential use on the severed and retained lots.

Statutory Public Meeting Information
The Corporation of the Township of Selwyn will hold a Public Meeting on Tuesday, April 12th, 2022 at 5:30 p.m. to consider the proposed Official Plan and Zoning By-law Amendments under Sections 17 and 34 of The Planning Act, R.S.O., 1990, as amended.

During the COVID-19 pandemic, regular meetings of Council are being held electronically.

Participation in the Public Hearing

Virtual

Any person may attend the virtual public hearing and make written and/or oral submissions either in support or opposition to the proposal. In order to make arrangements to attend the virtual hearing please contact the Clerk by email at achittick@selwyntownship.ca no later than 4:00 p.m. on the day prior to the scheduled public hearing. You will be given guidance and instructions on how to attend via Zoom. It is the responsibility of those interested in attending to have the technology in place to connect to the hearing.

In-Person
There will be limited opportunities for individuals to attend the hearing in person if you are unable to attend the virtual hearing. Please contact the Clerk via email at achittick@selwyntownship.ca for further details.


Suppporting Studies and Materials
In support of the applications, the following documents/studies weresubmitted and are currently undergoing technical review:

  • Planning Justification Report, prepared by EcoVue Consulting Services Inc., dated January 18, 2022, which includes a Well Report summary and a Minimum Distance Separation Calculation.
  • An Archaeological Study will be submitted prior to issuance of the building permit as a condition of a holding zone provision to be included in the proposed zoning by-law amendment.

The Right to Appeal
If a person or public body does not make oral submissions at a public meeting or make written submissions to the County of Peterborough in respect of the proposed Official Plan Amendment, or to the Township of Selwyn in respect of the proposed Zoning By-Law Amendment, before the approval authorities give or refuse to give approval to the Official Plan Amendment or Zoning By-Law Amendment, the person or public body is not entitled to appeal the decision of the approval authority to the Ontario Land Tribunal.

If a person or public body does not make oral submissions at a public meeting or make written submissions to the County of Peterborough in respect of the proposed Official Plan Amendment or to the Township of Selwyn in respect of the proposed Zoning By-Law Amendment, before the approval authorities make a decision regarding the amendments, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
